1. About these terms
medhyom.com is run by Medhyom, a sole proprietorship based in India ("Medhyom", "we", "us"). By using this site you accept these terms. If you do not accept them, please do not use the site.
2. Information only
Everything on this site, and in the videos, posts, code and other content Medhyom publishes anywhere, is general information. It is not professional, technical, financial or legal advice, and you should not rely on it as such. Code we publish is governed by the licence in its repository, including that licence's warranty and liability terms.
3. No offer and no contract
Nothing on this site is an offer, quotation, promise or commitment to provide any product or service. Contacting us, by the form or by email, does not create a contract, a client relationship or any obligation on either side. A reply from us, by email or otherwise, is not an offer, acceptance or quotation, and no email, message or call creates a contract. Any work or service would need a separate written agreement signed by both parties, and only that agreement would bind us. "Signed" means signed by hand or with an electronic signature valid under the Information Technology Act, 2000.
4. Products and services
Any product or service Medhyom describes, on this site, on any other Medhyom site such as app.medhyom.com, or on our social media accounts, is described for information only, whether or not it is marked "In development". Unless a separate signed agreement says otherwise, we make no commitment that any of them will be released or stay available, or about when, with which features, with what results, or at what price, and we may change or withdraw them at any time.
5. No warranty
The site and its content are provided "as is" and "as available". To the extent the law allows, we give no warranty of any kind, express or implied, including about accuracy, completeness, availability or fitness for a particular purpose.
6. Limitation of liability
To the extent Indian law allows, Medhyom is not liable for any loss or damage arising from your use of, or inability to use, this site, its content or anything else Medhyom publishes, including indirect or consequential loss and loss of data, profit, revenue or goodwill. Where Indian law allows liability to be limited but not excluded, our total liability to you is limited to INR 1,000. Nothing in these terms excludes or limits liability for fraud or wilful misconduct, any other liability that Indian law does not allow to be excluded or limited, or any right you have under the Consumer Protection Act, 2019.
7. Acceptable use
Do not misuse the site: do not attempt to break, overload or gain unauthorised access to it, send spam or malicious content through the contact form, or use the site for anything unlawful.
8. Your responsibility
You are responsible for any loss we suffer because you broke these terms or the law while using the site, to the extent the law allows.
9. Intellectual property
The Medhyom name, logo, design and content belong to Medhyom unless stated otherwise. You may view and share links to the site, but you may not copy, reuse or adapt its design or content without our written permission.
10. Other sites
Links to other sites and services are for convenience. We do not control them and are not responsible for them.
11. Privacy
Our Privacy Policy explains how we handle personal data.
12. Changes
We may update these terms at any time by changing this page and its date. Continuing to use the site after a change means you accept the updated terms.
13. General
If any part of these terms is found invalid or unenforceable, the rest remains in force. Our not enforcing a term is not a waiver of it. These terms and our Privacy Policy are the whole of what applies to your use of the site. If you and Medhyom sign a separate agreement, that agreement governs its subject and prevails over these terms.
14. Governing law and courts
These terms are governed by the laws of India. The courts at Jaipur, Rajasthan have exclusive jurisdiction over any dispute arising from them or from the site, except a dispute under a separate signed agreement, which is resolved as that agreement says.
